These official auction terms and conditions govern all sales conducted by Anderson Auction Group LLC. Furthermore, we provide these transparent guidelines to ensure every bidder understands our professional Texas auction process.

1. THE BINDING CONTRACT
1.1 Agreement to Terms: By registering, Bidder agrees to be bound by these terms. A bid is a legally binding contract. 1.2 Binding Obligation: A “Binding Obligation” is formed at the moment an item is declared “Sold” by the Auctioneer or the online platform. This obligation remains in effect regardless of clerical errors, payment delays, or title issues. 1.3 Announcements: Any announcements made on the day of sale take precedence.
2. HYBRID BIDDING PROCEDURES
2.1 On-Site vs. Online Tie Bids: Specifically, we give preference to the on-site bidder in the event of a tie. 2.2 Soft Close: Online timed auctions use a “Soft Close” logic. 2.3 Proxy Bidding: Our Proxibid platform bids incrementally on your behalf.
3. PAYMENT & BUYER’S PREMIUM
3.1 Buyer’s Premium: A Buyer’s Premium applies to all purchases. Specifically, check the individual auction listing on our Proxibid Gallery to confirm the premium for each specific event.
3.2 Payment Tiers: We charge invoices under $1,000 to the card on file. Larger invoices require Wire or Cash.
3.3 Default: Failure to pay results in a 10% late fee. 3.4 Chargebacks: Initiating a chargeback is a material breach of contract. 3.5 TERP Surcharge: A 1.5% surcharge applies to off-road diesel equipment over 50hp.
4. “AS-IS” & LIABILITY SHIELD
4.1 No Warranty: All items are sold “AS-IS, WHERE-IS” with no guarantees. 4.2 Inspection: Bidders are solely responsible for inspecting items. 4.3 Landowner Indemnity: You agree to indemnify the Auctioneer, Seller, and Event Land Owners from any claims of injury.
5. REMOVAL & ABANDONMENT
5.1 Removal Deadline: All items must be removed within the designated window. 5.2 Abandonment: Items left after the deadline are deemed abandoned. 5.3 Disposal Fees: Unwanted items left behind incur a disposal fee of $50 to $1,000.
6. TITLES & FIREARMS
6.1 Vehicle Titles: A $25 handling fee applies. 6.2 Firearms: Must be transferred through an FFL.
7. LEGAL JURISDICTION
7.1 Venue: Any legal disputes shall be settled exclusively in Tarrant County, Texas.
